Always Protecting Your Interests

Agencies can be fully confident in RACS Group’s compliance credentials following yet another positive communiqué from Her Majesty’s Revenue and Customs.

Titled ‘Employer Compliance review’ and dated 20th May 2014, the letter confirms that Her Majesty’s Revenue and Customs has concluded its review of RACS Group’s processes, expenses & payroll procedures which duly satisfied the Revenue’s legislative requirements. In the words of The Special Investigations Team (Umbrella-specific Audit):

‘Based on our conversation and documentary evidence I have now closed my enquiries’

Holiday Pay Ruling Affects Recruiters

The European Court of Justice (ECJ) has ruled that commission payments must be taken into account when calculating Holiday Pay, rather than being assessed purely on basic salary. APSCo believe that the ruling could have significant implications for the recruitment industry as most Consultants work in an incentivised environment and the new directive would naturally reduce their margin.

RACS Group has always adhered to this proposed legislation by accruing Contractor’s holiday pay including any commission payments at source. Holiday pay is calculated at 12.07% of all taxable income including national minimum wage, commission and bonuses.

The amount appears on their payslip and they can request their full entitlement in writing at any time. RACS Group also fully comply with all directives in relation to the practice of “rolling up” holiday pay and ensure Contractors receive their holiday pay when they actually take their holidays!!!

These factors demonstrate both how RACS Group embrace the spirit of the holiday pay ruling and our unwavering commitment to protecting agencies and their Contractors.
